Before one can begin to file a Qui Tam case, it is essential that they receive a Qui Tam lawsuit funding advance. This advance, or "Qui Tam funding", must be received prior to filing the lawsuit. The case filing must be done as soon as possible, or else the case may be dismissed because of insufficient funding. If the funding is not received, one may not be able to file the case until all monies owed has been repaid.
Once a plaintiff receives a Qui Tam lawsuit funding advance, they can start filing the lawsuit. During this time, if the case is a "no win no fee" case, the plaintiff will not be required to pay any fees until a judgment has been entered. For a lawsuit to be considered a "no win no fee" case, it must meet certain criteria set forth by the Qui Tam case funding program. In order for this to be the case, the lawsuit must be filed by a plaintiff that is either unemployed or has had his or her wages garnished by an employer in some way. The plaintiff's lawyer is the only one to receive compensation unless the case is settled outside of court. If this is the case, the plaintiff must be able to show that their lawyer did not charge any fees and does not have any other expenses to pay. These expenses include such things as expenses incurred by attending depositions, travel expenses, and meeting with attorneys. If the plaintiff cannot show this, the case will still be considered a "no win no fee" case, but it will not be as good.
After the case is accepted as a "no win no fee" case, the Qui Tam litigation funding agency will distribute the money to the plaintiff upon approval. In some cases, however, the court may require the plaintiff to repay the settlement advance before any money is disbursed. There is no maximum amount that the plaintiff must repay. upon settlement.
