There is a lot of confusion out there as to whether or not you actually need money during your TBI lawsuit. I will be honest and tell you that you definitely need the money, but you don't need it all at once. I will also tell you that you need it in stages over time if you want to be successful and have the best chance at success when it comes time for you to win your lawsuit.
When I was starting out with brain injury lawsuits and filing them, I started by asking myself the following question. "If the insurance company can't pay for my care right now, why would they cover a settlement? " This question is pretty straight forward when you are filing a lawsuit. If they think that you will be able to pay a large lump sum in a short period of time, they are going to be the ones paying for your settlement.
So how do you figure out who your brain injury lawyer should be? Your attorney should be someone that you trust, because you may not have access to your settlement until very late into the case. The reason that they will be your attorney is because they have experience in brain injury lawsuits. They will be able to determine what the best course of action is going to be for you in terms of paying for your settlement.
Some people have said that they will be glad to take your settlement in the beginning, because then they will be in control. They will get the lump sum in a matter of weeks or months. However, if you do not get the settlement during the first three to six months, you may end up losing out on a lot of money in interest.
Instead of waiting for a settlement to arrive, you may want to ask your lawyer to negotiate with the insurance company for you. I can tell you from personal experience that the company does not want to pay the amount that you need, but will settle for less than half. of what you actually deserve. They are looking to cut their losses, and will let you have a smaller amount that can be used in order to cover other expenses until you are paid enough to cover your settlement.
I would recommend you contact a legal assistance when filing your case, because this is where your lawyer is going to get the most out of the settlement that you deserve. If you have medical bills, then you will be able to pay for the lawyer fees with money that you have received during your settlement. Legal assistance is going to cost nothing, but a few dollars each month and you will not have to pay any tax, licensing, or business expense fees.
